These Terms of Service (“Terms”) govern access to and use of Zeusapp websites and software operated by Seferi Engineering Enterprises (“Zeusapp”, “we”, “us”). By using the Services you agree to these Terms. Contact: [email protected].
1. The Services
Zeusapp provides outbound and email tooling including prospecting, campaigns, mailbox warm-up, inbox, calendar, and Zeus AI drafting. Features may be waitlist-gated, change over time, or differ by plan. We may modify or discontinue features with reasonable notice where practicable.
2. Accounts & waitlist
You must provide accurate information and keep credentials confidential. You are responsible for activity under your account and workspaces. Waitlist access is discretionary. We may suspend accounts for risk, abuse, or non-payment.
3. Acceptable use
- No unlawful, deceptive, or harassing outreach; no spam.
- No unauthorized access, scraping beyond permitted product use, or interference with the Services.
- No malware, phishing, or content that infringes others’ rights.
- Comply with CAN-SPAM, GDPR/ePrivacy, and local marketing laws for your sends.
- Do not use Zeus to send content involving minors’ exploitation, hate crimes, or other illegal material.
4. Customer content & lists
You retain ownership of content and lists you upload. You grant us a limited license to host, process, and transmit that content solely to operate the Services. You represent you have all rights and lawful bases needed to use that content with Zeusapp.
5. Zeus AI
AI outputs are probabilistic and may be inaccurate or incomplete. You must review drafts before sending. Zeus AI does not auto-send without your action. You remain solely responsible for final copy, targeting, and compliance. We may use subprocessors to generate AI outputs under confidentiality and data-processing terms.
6. Mailboxes, domains & deliverability
You authorize Zeusapp to connect to mailboxes and sending domains you configure. Warm-up and sending limits do not guarantee inbox placement. Misuse that harms provider reputation may result in suspension.
7. Plans, trials & payments
Paid plans are billed as shown at checkout. Fees are generally non-refundable except where required by law. Payment processors (including Stripe, Paysera, and POK) handle card and local payment methods. Taxes may apply. Failure to pay may pause the Services.
8. Intellectual property
Zeusapp branding, software, and documentation remain our property (or our licensors’). These Terms do not transfer ownership. Feedback you provide may be used to improve the product without obligation to you.
9. Confidentiality
Each party will protect the other’s non-public information with reasonable care and use it only for performing under these Terms, except for information that is public, independently developed, or required to be disclosed by law.
10. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR SPECIFIC DELIVERABILITY RATES.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZEUSAPP AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICES WILL NOT EXCEED THE FEES YOU PAID US FOR THE SERVICES IN THE THREE (3) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MINIMUM PERMITTED.
12. Indemnity
You will defend and indemnify Zeusapp against claims arising from your content, lists, outreach, unlawful use, or violation of these Terms or third-party rights, except to the extent caused by our willful misconduct.
13. Suspension & termination
You may stop using the Services at any time. We may suspend or terminate access for breach, legal risk, or non-payment. Upon termination, your license ends; sections that by nature should survive will survive.
14. Governing law
These Terms are governed by the laws of Albania, without regard to conflict-of-law rules, unless mandatory consumer protections in your country of residence provide otherwise. Courts in Tirana have exclusive jurisdiction, subject to those mandatory protections.
15. Changes
We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance of the changes, except where consent is required by law.
